| Abstract: | This article is presented in four sections, beginning with a brief characterisation of Islamic constitutional law, and its under-developed status as compared with other branches of Islamic law. The discussion proceeds to highlight salient differences between the Islamic and western approaches to constitutional law. This is followed by a brief discussion of Islam and secularism. Section two provides a panoramic view of Islamic countries in general and their constitutions with special reference to the role and place of Islam, or that of a state religion in the constitution. Section three, the largest in the chapter, consists of a general characterisation of the Islamic system of rule under a number of sub-headings. The first of these characterises government in Islam as a trust (amanah); it is also a limited as opposed to a totalitarian government; that it is a qualified democracy; and that the Islamic government is characteristically civilian, not a theocracy. The chapter also reviews major trends and commonalties in the Sunni and Shia political thoughts, and then a conclusion. (پشتو) په اسلامي هیوادونو کې اساسي قوانين؛ اسلامي حقوقو ته معاصره کتنه محمد هاشم كمالي دا مقاله په څلورو برخو کې وړاندې شوې په پیل کې د اسلامي اساسي قانون خانګړتياوې خلاصه شوي چې دا برخه د اسلامي حقوقو د نورو برخو په پرتله لږه پرمختللې ده. دا بحث د اساسي قانون د غربي او اسلامي تګلارو په مهمو توپيرونو وړاندې ځي. ورپسې د اسلام او سکولاریزم په اړه لنډ بحث شوې. په دوهمه برخه کې په عمومي ډول د اسلامي هيوادونو، د هغوی د اساسي قوانینو په ځانګړي ډول په هغې کې د اسلام نقش او ځای او په اساسي قانون کې د مذهب وضعيت ته پراخه کتنه شوي په دریمه برخه - چې دا تر ټولو لوی څپرکې هم ده – کې د اسلامي نظام عمومي ځانګړتیاوو ته د څو فرعي عناوينو لاندې کتنه شوې. لمړی ځانګړتيا دا ده چې په اسلام کې حکومت یو امانت دی. بل دا چې دا د مطلق نظام په پرتله محدود نظام دی، دا چې دا په شرطونو ولاړه ډيموکراسي ده او دا چې اسلامي حکومت ملکي ځانګړتياوي لري، هغه د روحانيونو حکومت ندې. دا څپرکې د سني او شيعه سياسي فکرونو مهمو گرایشونو او د هغوی ترمنځ ورته والو ته هم ه کوي. او دمقالې په پایله کې د پورتنیو بحثونو لنډيز شوی دی |
