Die Drittwirkung der Grundrechte des Grundgesetzes im Vergleich zum koreanischen Verfassungsrecht

Abstract

Die sog. Dual-Ausstrahlungswirkung ist eine neue Lösung für die Drittwirkungsproblematik. Sie ist eine Differenzierung der bisherigen mittelbaren Drittwirkung der Grundrechte. Die (drei) Stufentheorie dient einer solchen Differenzierung. Die erste Stufe soll die Erweiterungsmöglichkeit der Dimensionen überprüfen, ob sich öffentliches Gebiet im Bereich des Privatrechts erweitern kann. In der zweiten Stufe wird die bisherige Ausstrahlungswirkung der Grundrechte als mittelbare Drittwirkung überprüft. Bei der dritten Stufe handelt es sich um die "vorläufige Ausstrahlungswirkung" der Grundrechte. Die bisherige Debatte in Verbindung mit der "unmittelbaren Drittwirkung" verkennt die vorläufige Ausstrahlungswirkung der Grundrechte. Die sich ändernde Ordnung der Staatsgemeinschaft (unter der Auswirkung des sich ausweitenden Bereichs der Information und des zunehmenden Bereichs der Kultur im Verfassungsleben) bedarf einer neuen Idee der Rechtsstaatsstruktur. Der sog. kooperative Rechtsstaat ist deswegen kommend. Der Begriff der "Kooperation" unterstützt die neue Funktion und Rolle der Grundrechte im kooperativen Rechtsstaat.

The so-called "Dual-Ausstrahlungswirkung(double effect of expend)" is a new solution for the "Drittwirkungsproblematik(third effect problem of civil rights)". It is different the so far known indirect third effect of civil rights. The three-step-theory serves this difference. The first step is supposed to check the possibility to widen a dimension so public law can expand into the field of private law. The second step checks the present "Ausstrahlungswirkung(effect of expend)" of civil rights as "mittelbare Drittwirkung (indirect third effect)". The third step is about "temporary effect of expend" of civil rights. The debate about the "unmittelbare Drittwirkung (direct third effect) " led so far misjudges the temporary effect of expend of civil rights. The changing order of state and society, influenced by the increasing field of information and the increasing subject of culture within the constitutional life, needs an new idea of constitutional state culture. The so-called "cooperative rule of law" is therefore coming. The term "cooperation" supports the new function and roll of civil rights in the cooperative rule of law or cooperative constitutional state.
