Abstract: Das Zahlen mit Bezahlkarten gehört mittlerweile zu den gängigen Zahlungsmethoden und gibt dem Kunden ein zusätzliches Maß an Flexibilität und Freiheit. Sowohl steigende wirtschaftliche Bedeutung der kartengesteuerten Zahlungssysteme als auch Verschärfung des Bankenkartellrechts durch die europäische Harmonisierung deuten allerdings auf gewisse wettbewerbsrechtliche Probleme in dieser moderner Art des Zahlungsverkehrs hin. Zu nennen sind vor allem die Problematik der sog. Nichtdiskriminierungsklausel, besondere Probleme des Einsatzes der Universalkreditkarten in Agentursysteme, zentrale Festlegung der Interbankenentgelte, einheitliche Gebühren für fremde Geldausgabeautomaten. Darüber hinaus werden im Zusammenhang mit dem immer steigenden Einfluss der beiden führenden Kreditkartenunternehmen Visa und Master Card auf den Markt für die Bezahlkarten die wettbewerbsrechtlichen Bedenken sowohl von den Wettbewerbshütern als auch von der Wissenschaft geäußert. Schließlich stellen sich vor dem Hintergrund der Europäisierung des Wettbewerbsrechts ebenfalls unlauterkeitsrechtliche Fragen, da die Werbeaussagen der Kreditinstitute beim Vertrieb moderner Finanzdienstleistungen zur Irreführung der Kunden führen können. Die Zielsetzung der Arbeit bestand darin, die Gegebenheiten und die aktuellen wettbewerbsrechtlichen Probleme moderner Zahlungssysteme in Deutschland darzustellen und die unterschiedlichen Vorschläge zur Lösung dieser Probleme miteinander abzuwägen. Als Weiteres sollte die Rechtslage in Russland unter Berücksichtigung der für Deutschland gewonnenen Ergebnisse vergleichsweise gegenübergestellt werden, um die Hemmfaktoren für die Entwicklung der kartengesteuerten Zahlungssysteme in Russland zu erfassen und zu analysieren. Hierbei sollen zum einen die zivilrechtlichen Beziehungen zwischen den Beteiligten untersucht werden, zum anderen die den kartengesteuerten Zahlungssystemen zu Grunde liegenden Vereinbarungen und Abkommen. Dabei geht es um die Analyse sowohl klassischer zivilrechtlicher Bereichen, wie AGB-Regelung, Verbraucherschutz als auch rein wettbewerbsrechtlicher Fragenkonstellationen, die für die Entwicklung der kartengesteuerten Zahlungssysteme Bedeutung haben. Die Untersuchung zeigt, dass das Zusammenspiel der Preisregelungen und Sonderverträgen (Lizenz-, Akquisitions- uns Emissionsverträgen) insbesondere im Rahmen des Kreditkartenverfahrens dazu führt, dass die Interbankengebühren nicht entscheidend durch die Kostenfaktoren (Processingkosten, die Kosten der freien Periode und die Kosten der Zahlungsgarantie) beeinflusst werden. Das hat zur Folge, dass die Prozentsätze der Interbankenentgelte nach wie vor vom Einfluss des Wettbewerbs ausgeschlossen sind. Das führt zur Verstärkung der faktischen Marktmacht der Kreditkartenunternehmen Visa und Master Card.
The payment via plastic cards belongs to the curent payment instruments these days and offers the user an additional degree of flexibility and freedom. The increasing economic importance of the payment card scheme as well as the tightened up bank antitrust law by the European harmonisation yet indicate certain antitrust law aspects in this modern kind of payment transaction. To be mentioned are especially the problems about the so called "No-surcharge rule", certain problems in the usage of credit cards in agency relationships, the collective institutional determination of the interchange fees and uniform fees for foreign automated teller machine [short: ATM]. Furthermore, competitive and antitrust as well as scientific doubts were mentioned in the context of the increasing influence of the two leading credit card associations, VISA and Master Card, on the market of credit cards. In the background of the Europeanisation of the competition law questions raise in the area of the payment card scheme, for the advertisement of the banks at sales and marketing of modern financial services may lead the client astray. Target of this work will be, to present the current conditions, competitive and anti-trust problems of modern payment instruments and to weigh up different ideas of solutions in this matter. In addition, in order to register and analyze the abashments for the development of the payment card schemes, the legal position of Russia will be compared to the received results of Germany. At this point civil relations between the involved countries will be researched as well as agreements and regulations settling the payment card schemes. This involves at first the analysis of classical civil areas such as standard form contract and consumer protection and secondly competitive and antitrust questions, which have an impact on the development of the payment card schemes. The analysis shows that the coorperation of the cost control and special agreements (license, acquisition and issue agreement) leads to the fact that interchange fees are not decisively influenced by the cost features (costs of processing, costs of interest-free period and costs of payment guarantee), especially in the context of credit card scheme. Consequently, the level of interchange fees still excluded from the influence of the competition. This leads to the reinforcement of the effective market power of the credit card associations VISA and Master Card.
